Legislative panel splits 3-1 on sign law rewrite

Northampton planning and legislative panels advance a sign ordinance rewrite, split 3-1 on the way. The Committee on Legislative Matters first deadlocked 2-2 on a neutral recommendation before voting 3-1 to positively recommend the rewrite, which strips content-based sign rules to comply with U.S. Supreme Court precedent; the Planning Board backed it unanimously.
Director of Planning and Sustainability Carolyn presented a new 10-square-foot "Type 2" ground sign category that members left uncapped in number after Councilor Garrick Perry argued limits would "limit creativity for businesses." Former Ward 1 Councilor Stan Moulton warned the rewrite "didn't do anything to create new enforcement mechanisms," while resident Dan Breindell said his own "Dan for mayor" campaign sign would become illegal under the new rules. Both bodies also unanimously recommended amendments to pre-existing non-conformity rules required by a state law change, extending the window to revive an abandoned non-conforming use from two to four years. A third item, new permitting rules for small batteries and solar facilities under state regulation 225 CMR 29.00, was continued to October 8 after members questioned whether a proposed 500-kilowatt-hour residential storage threshold was too large.
